Electronic procedure before the Council of StateThe Royal Decree of 13 January 2014 allows not only lawyers but also individuals acting in their own name, to opt for the electronic procedure before the Administrative Litigation Section of the Council of State. This procedure is determined by article 85bis of the Decree of the Regent of August 23, 1948 determining the procedure before the Administrative Litigation Section of the Council of State. Procedural documents can now be sent and exchanged via a secured website (e-ProAdmin) where people can register by means of their identity card. Petitions and other procedural documents (as well as their annexes) may be filed in electronic form. Parties are notified by e-mail of the filing of subsequent procedural documents which they can then consult in the electronic file. The electronic procedure is an option: parties that desire to receive hard copies of the documents can do so as before, but parties opting for the electronic procedure will consult the electronic version of the documents submitted in hard copy by the other parties. The new regulation entered into force on 1 February 2014. The user manual (FR, NL) is available online (v.1.4 of 29/07/2014). |
