Lodging an action for annulment does not have any suspensive effect, which means that the contested decision remains valid and can be implemented. That is why an applicant party can ask for a temporary suspension of the decision, pending the possible annulment. It can do so either immediately in the application for annulment or in a later application before the deposit of the Auditor’s report.
